These Terms and Conditions of Use (“Terms”) apply to all programs, products, services, and content offered by Amanda Dumouchelle LLC (“Company,” “We,” “Us,” “Our”), located in Michigan, USA.

“You” and “Your” refer to any purchaser, client, participant, or user accessing any Company offering, website, platform, content, communication, or service (collectively, the “Offering(s)”).

NOTICE: These Terms are legally binding. By purchasing, accessing, or participating in any Offering, You agree to these Terms.

GENERAL PROVISIONS

You must be at least 18 years old to purchase or participate in Our Offerings. By enrolling or purchasing, You confirm You are legally able to enter into this Agreement.

We make reasonable efforts to maintain secure platforms and professional tools, but We do not guarantee uninterrupted access or error-free delivery.

We may update these Terms at any time. The most current version will be reflected by the “Last Updated” date above.

SCOPE OF OFFERINGS

These Terms apply to all current and future Offerings, including but not limited to:

Align & Elevate (digital course / training)

Personal Mastery (1:1 coaching / mentorship)

Personal Design Insights (recordings, mini-readings, check-ins, audits)

Digital products (downloads, templates, trainings, PDFs, recordings)

Workshops, intensives, programs, subscriptions, or community spaces

Any related communications (email, voice notes, WhatsApp, Substack, etc.)

Specific details (deliverables, timelines, pricing) are defined on the applicable sales page, checkout page, or written agreement at the time of purchase.

PURCHASE TERMS

By purchasing or participating in any Offering, You agree to comply fully with these Terms.

If You do not agree, You must not purchase or access Our materials and should contact Us before proceeding.

All prices are listed in USD unless otherwise stated.

NO MEDICAL / MENTAL HEALTH ADVICE

Our Offerings provide education, coaching, and personal development support, which may include Human Design, nervous system tools, mindset coaching, subconscious work, and related modalities.

We are not providing medical, psychiatric, or legal services.
Nothing in any Offering is a substitute for licensed medical, mental health, or professional advice.

You are responsible for your own well-being, decisions, outcomes, and interpretations.

INTELLECTUAL PROPERTY & CONTENT USE

All content and materials provided through any Offering are the exclusive intellectual property of Amanda Dumouchelle LLC, including but not limited to:

course modules, PDFs, trainings, frameworks, systems, worksheets

written explanations, graphics, slides, videos, audio recordings

prompts, templates, client examples, case studies, tools

coaching materials and proprietary methods

any AI-related content, including Neutrina and any associated outputs

You are granted a limited, non-transferable, revocable license for personal use only.

You may not:

reproduce, copy, sell, upload, publish, share, or distribute any materials

share access with anyone (friends, clients, assistants, colleagues, etc.)

re-teach, repackage, summarize, or present Our frameworks as Your own

reverse engineer or create derivative offerings using Our materials

use Our content to train any AI system, automated tool, or dataset (including ChatGPT, custom GPTs, bots, or software tools)

Violation may result in immediate removal from the Offering without refund and possible legal action.

CONFIDENTIALITY

You agree not to disclose or distribute confidential Company materials, proprietary methods, internal teachings, or paid resources to any third party.

The Company agrees not to use Your name, likeness, private messages, or identifying information for marketing without Your explicit written consent.

PAYMENT, BILLING & REFUNDS

Digital Products + Courses

Due to the digital and immediately accessible nature of most Offerings (including Align & Elevate and all digital products), all sales are final.

No refunds are offered for any reason unless required by law.

Coaching + Service-Based Deliverables

For service-based Offerings (including recordings, coaching, intensives), all sales are final once delivery begins.

If You miss a session, delay submitting required information, or do not use access provided, You remain responsible for full payment.

Failed Payments

If Your payment method fails, is reversed, or is disputed, We may suspend or terminate access until resolved.

Chargebacks

Initiating a chargeback without contacting Us first is considered a breach of these Terms and may result in immediate termination of access, removal from services, and legal collection efforts.

PERSONAL DESIGN INSIGHTS (RECORDINGS / CHECK-INS)

If You purchase or receive a Personal Design Insight recording:

You are responsible for providing accurate birth information and context

delivery timelines (if stated) apply to business days

turnaround estimates are not guarantees, but We will make best efforts to meet them

recordings are educational and coaching-based, not therapy or clinical treatment

All recordings are for personal use only and may not be redistributed.

PERSONAL MASTERY (1:1 COACHING) TERMS

Personal Mastery is an ongoing coaching container unless otherwise stated in writing.

Ongoing Billing + Auto-Charge

If You enroll in Personal Mastery as a monthly coaching arrangement, You authorize automatic recurring charges to Your payment method on the schedule shown at checkout.

You understand this is an ongoing membership-style coaching arrangement, and payments will continue unless canceled properly.

Cancellation Policy (10–15 Day Notice)

To cancel Personal Mastery, You must email [email protected] at least 15 days before Your next billing date.

If You cancel after the 15-day window, Your next payment may still process and services will continue through that paid period.

Session Use Policy (If Applicable)

If Your Personal Mastery plan includes a monthly number of sessions:

sessions must be used within the month they are offered

unused sessions do not roll over unless explicitly stated

rescheduling policies may apply depending on availability and notice

Communication + Support Boundaries

If WhatsApp or between-session support is included, response times and availability are limited to the business hours stated in Your program description or onboarding message.

COMMUNITY SPACES & CONDUCT

If any Offering includes access to a community space (group, chat, forum, platform), You agree to:

maintain respectful communication

not harass, shame, or solicit members

not share or distribute proprietary content

We reserve the right to remove any participant for misconduct or violations, without refund.

TERMINATION

We may terminate or revoke access to any Offering immediately if You violate these Terms, including but not limited to:

sharing materials or login access

intellectual property infringement

payment disputes or chargebacks

abusive behavior, harassment, or boundary violations

No refunds will be provided upon termination for violations.

FORCE MAJEURE

Neither Party is liable for delays or interruptions caused by events outside reasonable control (natural disasters, outages, war, illness, government actions, etc.).

If such an event extends beyond 30 days, either Party may terminate this Agreement. Payments already made remain non-refundable.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, We are not liable for any indirect, incidental, or consequential damages arising from your participation or use of any Offering.

You agree that outcomes vary, and You remain fully responsible for your decisions, actions, and results.

MAXIMUM DAMAGES

If liability is found, the maximum liability of the Company shall not exceed the total amount You paid for the specific Offering giving rise to the claim.

INDEMNIFICATION

You agree to indemnify and hold harmless the Company from any claims, damages, losses, liabilities, or expenses arising out of:

Your misuse of materials

Your violation of these Terms

Your infringement of intellectual property

Your actions based on the information provided

GOVERNING LAW + DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Michigan, USA.

Any dispute will be addressed through mediation or alternative dispute resolution before litigation, unless prohibited by law.

ENTIRE AGREEMENT

These Terms represent the entire agreement between You and Amanda Dumouchelle LLC regarding Our Offerings and supersede all prior communications.

By purchasing or participating in any Offering, You confirm that You have read, understood, and agreed to these Terms.
